The terms that apply when you use our services.
Last updated: [INSERT DATE]
These terms apply to digital services provided by AL SYED ENTERPRISES LTD, company number [INSERT VERIFIED COMPANIES HOUSE NUMBER], registered office [INSERT VERIFIED REGISTERED OFFICE ADDRESS] (“we”, “us”). By approving a quote, you agree to these terms together with the written details confirmed for your project (the “Project Confirmation”). If the two conflict, the Project Confirmation applies.
Some parts of these terms apply differently depending on whether you are a consumer (acting for personal purposes) or a business. Nothing in these terms affects your statutory rights as a consumer.
We provide embroidery digitising, vector artwork conversion and graphic design services. The exact work, deliverables and file formats for each project are set out in the Project Confirmation. Anything not listed there is outside the agreed scope.
An enquiry or quote is not a contract. A contract is formed when you approve the Project Confirmation in writing (including by email) and, where applicable, make any required payment. We may decline any project at our discretion, for example where artwork appears to infringe someone else's rights.
Prices are quoted individually for each project and stated in [CURRENCY — CONFIRM]. Payment terms [CONFIRM: e.g. full payment before work begins / deposit / payment on delivery] and accepted payment methods are stated in the Project Confirmation. [CONFIRM VAT POSITION]
Deliverables are supplied electronically by [CONFIRM: email / download link / file-sharing service]. Timelines given are estimates, confirmed for each project. Delivery is complete when the files are sent to the email address or channel you provided. Please download and keep copies of your files.
No physical goods are shipped for these services.
Revisions included in the price are stated in the Project Confirmation [CONFIRM YOUR REVISION POLICY]. Requests that change the original brief (for example a new size, format or design) are treated as new work and may be quoted separately. We will always correct errors that are our fault.
You keep ownership of the artwork and material you provide. When you have paid in full, you may use the final deliverables for the purpose agreed in the Project Confirmation [CONFIRM: full transfer of rights or licence; whether you may show work in your portfolio]. Unless agreed otherwise, we keep ownership of working files, drafts and unused concepts.
You are responsible for making sure that material you ask us to reproduce does not infringe anyone else's rights.
Cancellations and refunds are handled under our Refund & Cancellation Policy, which forms part of these terms.
We provide our services with reasonable care and skill. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence or for fraud.
For business customers, we are not liable for indirect or consequential loss, loss of profit, or losses arising from production use of files that were not tested, and our total liability for a project is limited to the price paid for that project. [LEGAL REVIEW REQUIRED]
For consumers, we are responsible for foreseeable loss caused by our failure to comply with these terms, and we are not responsible for loss that was not foreseeable.
These terms are governed by the law of England and Wales [CONFIRM]. If you are a consumer living elsewhere in the UK, you may also bring proceedings in your local courts.
